Mapendekezo ya Mpango wa Tatu wa Maendeleo wa Taifa kwa Miaka Mitano (2021/2022 – 2025/2026) na Mapendekezo ya Mpango wa Maendeleo wa Mwaka 2021/2022 pamoja na Mapendekezo ya Muongozo wa Maandalizi ya Mpango wa Bajeti ya Serikali kwa Mwaka 2021/2022
MHE. DKT. PINDI H. CHANA: Mheshimiwa Mwenyekiti, ahsante sana.

Mheshimiwa Mwenyekiti, awali ya yote, naomba niungane na Watanzania wenzangu kumpongeza sana Mheshimiwa Rais wetu mpendwa, Dkt. John Pombe Magufuli. Mheshimiwa Rais amefanya kazi nyingi kubwa na wataalam wa Kiswahili wanasema mwenye macho haambiwi tizama. (Makofi)

Mheshimiwa Mwenyekiti, pongezi hizi zinatoka ndani ya nchi na nje ya nchi. Ukiwa nje ya nchi unaposema tu unatoka Tanzania kwanza lazima upokee salama na pongezi za Mheshimiwa Rais. Utaambiwa tunampenda sana Mzee Magufuli, anafanya kazi na amekuwa ni mfano ndani ya Jumuiya ya Afrika Mashariki, Afrika na duniani kote. (Makofi)

Mheshimiwa Mwenyekiti, vilevile niwashukuru wananchi wa Njombe kwa ridhaa yao ya kunirudisha tena mjengoni. (Makofi)

Mheshimiwa Mwenyekiti, moja kwa moja niende kwenye suala nzima la kilimo. Mikoa ya Kusini kwa asilimia kubwa sana wamejikita kwenye masuala ya kilimo na Mkoa wa Njombe kuna kilimo cha mazao mengi kama viazi, mbao zinakwenda mpaka nje nchi ndani ya Jumuiya ya Africa Mashariki ambapo kuna masoko mengi sana lakini pia kuna suala nzima la mahindi. Mheshimiwa Mwenyekiti, niipongeze sana Serikali ya Awamu ya Tano eneo la mahindi na pembejeo wamefanya kazi nzuri lakini tuendelee kuangalia bei za mbolea ni namna gani tutaweza kufanya ili mbolea iendelee kuzalishwa nchini ili bei ipungue. Sasa hivi mfuko mmoja kwa mbolea ya kukuzia ni Sh.50,000 hadi tumalize kilimo, mkulima anakuwa amewekezq sana. Kwa hiyo, eneo la pembejeo za kilimo hususani zao la mahindi, naomba tuendelee kuliboresha.

Mheshimiwa Mwenyekiti, pamoja na hilo, nipongeze kwa masoko ambayo yako na masoko mengi sasa hivi ni soko huria lakini kwa kweli tunahitaji kuona intervention, ni namna gani tunahakikisha wananchi wakishalima zao hili la mahindi wanapataje masoko ya uhakika. Nilete salama kutoka Mkoa wa Njombe, nadhani Waziri wa Kilimo ananisikia, yupo hapa jirani yangu wanaomba mahindi yakanunuliwe. Kuna mahindi mengi sana, ili yasiweze kupotea kutokana na upotevu unaotokea mara baada ya kilimo na kwenye hotuba imesekana wakati mwingine 40% ya mahindi wakati mwingine yanapotea (postharvest) basi tuone namna ya kuyanunua mahindi haya. Kuna mahindi mengi wanaomba SGR, NFRA ikiwezekana wakayanunue na wawaunganishe wakulima wa Mikoa hii ya Kusini na maeneo mbalimbali kama World Food Program, FAO, tuna kambi nyingi za wakimbizi wanahitaji chakula cha kutosha tuone namna gani ya kuunganisha eneo hilo. Mheshimiwa Mwenyekiti, eneo lingine naanza na pongezi ni suala nzima la elimu. Sasa hivi uandikishwaji wa watoto umetoka asilimia 93 mwaka 2015 sasa hivi tuko takribani asilimia 110. Tunapoelimisha vijana wengi maana yake wanakuwa na ubunifu, wanaweza wakabuni bidhaa na huduma mbalimbali na kuzalisha. Kwa hiyo, eneo hili ni muhimu lakini sasa tuangalie na vyuo vya maendeleo, kuna maeneo ambayo tuna miradi ya mkakati (flagship projects) tunahitaji vyuo vya maendeleo ambavyo vitasaidia ku-boost miradi ile. Kwa mfano, maeneo ya Miradi ya Mchuchuma na Liganga, Mwalimu Nyerere Hydroelectric Power, tuhakikishe tunavyo vyuo vya kutosha ili kuimarisha vijana ili waweze kupata ajira na kadhalika.

Mheshimiwa Mwenyekiti, Wilaya ya Ludewa mpaka sasa hawana chuo cha VETA. Nitumie nafasi hii kwenye mpango huu tuone namna gani tunaweza tukatumia force account ili waweze kuweka VETA pale ambayo ita-boost Miradi ya Mchuchuma na Liganga. (Makofi)

Mheshimiwa Mwenyekiti, vilevile nipongeze sana Mradi wa Mchuchuma na Liganga upo kwenye Ilani na pia umeelezwa vizuri sana kwenye Mpango. Pamoja na hiyo, tuangalie suala zima la fidia kwa wananchi kama tumeshalikamilisha siyo tu katika Mradi huu wa Mchuchuma na Liganga lakini na miradi mingine.

Mheshimiwa Mwenyekiti, vilevile katika maeneo ya madini kuna suala la wachimbaji wadogo…

Muswada wa Sheria ya Marekebisho ya Sheria Mbalimbali wa Mwaka 2021 (Toleo la Kiingereza)
MHE. DKT. PINDI H. CHANA: Mheshimiwa Naibu Spika, ahsante sana. Nianze kuungana na Waheshimiwa Wabunge wenzangu na Watanzania kutoa pole kwa mwenzetu ambaye ametangulia mbele ya haki.

Mheshimiwa Naibu Spika, moja kwa moja nianze kwa kuunga mkono hoja. Nampongeza sana Mheshimiwa Rais, Dkt. John Pombe Magufuli, hivi karibuni katuonyesha mfano wa umuhimu wa lugha ya Kiswahili katika maamuzi ya Mahakama. Mheshimiwa Rais amempandisha cheo Mheshimiwa Jaji aliyetoa hukumu kwa lugha ya Kiswahili. Kwa kweli huu ni mfano wa kuigwa na ni maboresho ambayo ni muhimu sana. Nami najiuliza, ilikuwaje siku za nyuma hili hatukuliona? Kimsingi jambo hili lilipaswa kuja mapema, lakini sasa limekuja wakati muafaka. (Makofi)

Mheshimiwa Naibu Spika, Nina sababu nyingi kwa nini naunga mkono kwamba lazima sasa tutumie lugha ya Kiswahili. Tunapotumia Kiswahili, hiki kifungu cha 84 kama kinavyoeleza katika Muswada huu wa Marekebisho kimesema pale, “The language of the laws of the United Republic of Tanzania shall be Kiswahili.” Napigia mstari neno “shall” and not “may”. Ni muhimu sana tuzungumze Kiswahili. Watanzania takribani milioni 60 lugha yetu ya Taifa ni Kiswahili. Wanawake katika idadi ya watu ni takribani asilimia 51 ya idadi ya watu na vijana ni takribani asilimia 60, wote hawa wanajieleza vizuri sana kwa lugha ya Kiswahili. (Makofi)

Mheshimiwa Naibu Spika, zipo faida za kutumia Kiswahili. Unapotumia lugha ya Kiswahili, kuna sheria, kwa mfano, tunapoambiwa huruhusiwi kushika nyara za Serikali halafu nyara zimeandikwa kwa lugha ya Kiingereza, masuala ya Government trophy, unaambiwa ngozi ya nguchiro ni nyara za Serikali, hiki na hiki ni kosa la jinai, halafu iko kwa Kiingereza. Hivi hawa wananchi wa kule Njombe, Iringa, Ludewa wanaelewa? Kwa hiyo, hili ni jambo la kupongezwa sana kutumia lugha ya Kiswahili. Hii lugha ya Kiswahili kwanza itapunguza hata uhalifu kwa sababu mtu akisoma anajua kumbe hii ni nyara ya Serikali. (Makofi)

MHE. BALOZI DKT. PINDI H. CHANA: Mheshimiwa Spika, ahsante sana. Awali ya yote naunga mkono hoja. Nampongeza Mwanasheria Mkuu kwa kutuletea Muswada huu. Moja kwa moja naenda kifungu kinachohusu Amendment of the Advocates Act. Kuna neno “Ethics” kwamba Regional Advocates Ethics Committee. Kamati inasema wanaweza wakaliacha neno “Ethics” au wakalitoa neno “Ethics” Kamati itakuwa comfortable.

Mheshimiwa Spika, binafsi neno “Ethics” lina umuhimu wake. Ethics is concerned with what is good for individual and society. Kwa hiyo, hizi Kamati za Mawakili za Mikoa ziitwe Kamati za Maadili na kama ile ya Kitaifa National Advocates Committee haina neno “Maadili” binafsi napendekeza basi na kule tuongeze. Kwa hiyo, tunapotoa neno “Ethics” tunataka kutengeneza nini? We need to have ethics. Ethics is very important to individual, our society and our country. So, naomba ni-submit haya mapendekezo kwamba neno “Ethics” kwenye Regional Advocates Committee; kwa sababu pale tunaunda hiki chombo kuangalia maadili ya hao wanasheria. Lazima akichukua kazi ya mtu awajibike kwa wakati, a-appear na kadhalika na kadhalika.

Mheshimiwa Spika, kwa hiyo, neno “Ethics” naunga mkono, kama lilivyoletwa na Serikali katika Muswada, lakini endapo ile Kamati ya Kitaifa haina neno “Ethics”, ili lifanane, basi tuone namna ya pale juu kuweka neno “Ethics”.

SPIKA: Kwa hiyo, isomekeje?

MHE. BALOZI DKT. PINDI H. CHANA: Mheshimiwa Spika, isomeke “The Regional Advocates Ethics Committee” for (a) pale Kifungu cha 4(1) “there is established in each region, the Regional Advocates Ethics Committee which shall, compose of…” inaelezea.

SPIKA: Kwa hiyo, itakuwa ni Kamati ya ku-deal na ethics only? Au huenda hiyo Kamati ina mambo mengine?

MHE. BALOZI DKT. PINDI H. CHANA: Mheshimiwa Spika, inakuwa na mambo mengine ambayo yameelezwa kwenye sheria, lakini neno “Ethics” naomba liendelee kuwepo.

MHE. BALOZI DKT. PINDI H. CHANA: Mheshimiwa Spika, ahsante. Eneo lingine ni Kifungu cha 2 ambacho kinasema: “The Regional Advocates Ethics Committee may appoint any public officer.” Itamchagua mtumishi yeyote wa Serikali to be the Secretary of the Regional Advocates Ethics Committee. Kumekuwa na maoni mbalimbali, wengine wanasema badala ya kumchukua labda huyu Afisa wa Serikali, labda itangazwe na kadhalika. Nilikuwa naangalia tuna mikoa mingapi haraka haraka, labda mikoa 26 maana yake nafasi 26 Sekretarieti ya Ajira au Tume ya Mahakama ikatangaze, yamkini inaweza ikachukua muda, tukaambiwa bajeti haitoshi.

Mheshimiwa Spika, binafsi naomba niunge mkono kwamba tuwe na huyu public officer. Tunachoweza kufanya, huyu public officer tuseme awe na qualification zipi? Je, awe ana degree ya sheria au degree yoyote? Kwa hiyo, binafsi nadhani hapa ni vema...

Balozi Pindi kwamba alikuwa anasisitiza suala la kuweka neno “Ethics” lakini kwa sasa hivi inavyosomeka kwenye sheria Kifungu cha (7) kinaongezeka Kifungu cha (4) (A): “there is established in each Region the Regional Advocates Ethics Committee.” Kwa hiyo, Ethics bado ipo. SPIKA: Utazingatia taarifa hiyo.

MHE. BALOZI DKT. PINDI H. CHANA: Mheshimiwa Spika, sawa. Kwa hiyo, neno “Ethics” kwa kweli kama tulivyoona ni la msingi sana na ni muhimu, ahsante kwa maelezo hayo. Kwa hiyo, pale kwenye eneo la any public officer, naunga mkono awe ni public officer lakini tuongeze tu qualification.

Mheshimiwa Spika, eneo lingine naungana pia na maoni ya Kamati kuhusiana na cheti cha kifo, kwamba cheti cha kifo endapo umetokea msiba, aruhusiwe kuchukua spouse (mke au mume) au mtoto, lakini vile vile next of kin. Huyu next of kin, huyu ndugu asiruhusiwe tu pale ambapo mke au mtoto hawapo. Ninao mfano, ofisi yangu ya Mbunge Viti Maalum Njombe nimetumika maeneo mengi kama next of kin, wakati mke wa marehemu yupo na pia mtoto wa marehemu yupo. Huyu mke wa marehemu anatokea Kijiji cha Manga wilaya ya Ludewa, ni mama mkulima. Ukimwambia bee, kachukue cheti cha baba, anakwambia, kah, ndibite kweyo? Haelewi. Incapable kutokana na sababu moja au nyingine. Mtoto under 18, lakini wote wapo.

Mheshimiwa Spika, sasa tukisema ni lazima mke akiwa hayupo ndipo next of kin aende au mtoto akiwa hayupo; kuna mazingira, mke yupo lakini incapable. Yaani hata hiyo ofisi inatakiwa moli moli (pole pole). Mtoto yupo under 18 sheria under 18 huwezi kwenda, kwa hiyo, next of kin aruhusiwe pale ambapo hata mke yupo, hata mtoto yupo lakini they are incapable. Kuna mazingira incapable. Wakati mwingine kuna suala la ufahamu wa akili, wapo lakini kidogo inabidi kumwongoza pole pole. Kwa hiyo, kutokana na ushuhuda huu, nimetumika maeneo mengi kadhaa kisheria kwenda kuwachukulia vyeti.

Mheshimiwa Spika, kwa hiyo, naomba iwe kwamba “notwithstanding subsection (1) a death certificate “may” (siyo “shall”), may be collected by the surviving spouse or child or next of kin if for any reason the spouse or child is incapable of collecting the certificate.” Wanaweza kuwepo lakini hawana uwezo.

Mheshimiwa Spika, pia ni vizuri kuweka kifungu caveat, endapo ndugu, jamaa na marafiki wa ile familia ya marehemu wana pingamizi ya huyu next of kin wanayo haki ya kwenda kupinga, huyu bwana hapana. Sisi hata kama fulani anasema kamchukulie cheti cha kifo, aah lakini sisi tunachoona bwana, hapana. Kunakuwa na caveat.

Mheshimiwa Spika, kwa hiyo, “propose addition of another subsection which defines the right of lodging a caveat to the person who is collecting the dearth certificate.”

Mheshimiwa Spika, ahsante. Najua Ofisi ya AG tuko pamoja. Kifungu cha (30) under Amendment of the Companies Act, naungana na maoni ya Kamati na niwapongeze sana Kamati, Mwenyekiti big up. Pale Na. 5 “notwithstanding subsection (1), a person shall not be eligible to incorporate a company if such person is reported by competent authorities to have been convicted or associated with instances of or related to money laundering”, masuala ya terrorism hawezi kuwa sehemu ya shareholders wa Kamati. (Makofi)

Mheshimiwa Spika, katika Kifungu hiki naungana na Kamati. Wao wamesema tutoe lile neno “associated with instances”, maana mtu anaweza akawa associated kwa namna nyingi. Pia wamesema related; neno “related” pia litolewe. Ila hiki Kifungu ni muhimu.

Mheshimiwa Spika, suala la madawa ya kulevya ni changamoto. Tanzania sasa hivi tuko katika SADC tunashirikiana na nchi mbalimbali Seychelles, wapi kuangalia madawa ya kulevya yanapita kwenye Indian Ocean, lazima tuweke vidhibiti, watu wasije wakafanya madawa ya kulevya, money laundering, baadaye anakuja anafungua Kampuni, anasema anatusaidia, kumbe ana changamoto kama hizo.

Mheshimiwa Spika, kwa hiyo, hiki Kifungu nakiunga mkono kisitoke, lakini tuki-draft tu properly. Naunga mkono kifungu hiki. Juzi juzi hapa tunaona mtu anaua watu na bunduki Selander, ugaidi kwenye mitandao; kwa hiyo, lazima tudhibiti hii mianya.

Mheshimiwa Spika, kifungu kingine ukurasa wa 24 Part (11) “Amendment of National Assembly Act.” Kimekuja Kifungu kinasema “upon the dissolution of Parliament, all powers and functions of the commission shall be vested to the chairman of the commission until new members of the commission are elected or appointed.”

Mheshimiwa Spika, naunga mkono kwa sababu, pale ambapo hatuna Wabunge limevunjwa, maana yake makamishna hawapo. Katika Bunge hili tuna kazi nyingi, utekelezaji wa masuala mengi ambayo yako chini ya Tume. Sasa tukisema tunasubiri Tume, Wabunge waapishwe, hapa tunamwachia Mwenyekiti. Functions and powers to be vested. Bunge ni mhimili. Tuna Mhimili wa Mahakama, Mhimili wa Bunge. Bunge ni mhimili muhimu na kunakuwa na kazi nyingi hata kama makamishna hawapo. Huwa tunavunja Bunge hapa mwezi wa Sita, mpaka watu wakaapishwe, warudi, ziundwe Kamati, wachaguliwe, yamkini inachukua muda kadhaa.

Mheshimiwa Spika, tukiacha kusema hizi functions and powers zisiwe kwa Mwenyekiti, itakuwa ni changamoto. Huu mhimili unakuwa haupo. Wanakuja viongozi wanataka kuonana na Bunge…

THE WRITTEN LAWS (MISCELLANEOUS AMENDMENTS) (NO. 4) ACT, 2021
MHE. BALOZI DKT. PINDI H. CHANA: Mheshimiwa Spika, ahsante sana. Nianze kwa kuipongeza Serikali na Mwanasheria Mkuu kwa kutuletea haya maboresho ambayo ni muhimu sana. Moja kwa moja naenda kwenye Ibara 10, 15A pale inaelezea kuhusu Waheshimiwa Majaji Wastaafu kwamba watakuwa wanalipwa kupitia Mhimili wa Mahakama; na pale tumesema Chief Court Administrator. Naunga mkono hiyo na napendekeza, kwa kuwa hapo tumesema Chief Court Administrator, Mtendaji Mkuu wa Mahakama.

Mheshimiwa Spika, vile vile ukurasa wa 17 pale amendment of political service retirement benefits ambapo inazungumzia retired Speaker or retired Deputy Speaker and their representative spouses, their entitlement shall be paid through the Office of the National Assembly. Napendekeza neno “Office the Clerk of the National Assembly.” Kwa sababu huku tumesema Chief Court Administrator, so napendekeza iwe “the Clerk…”

Sentensi ya last but one inasema, “Retired Speaker or Retired Deputy Speaker and their respective spouses are entitled; Eh, imeandikwa “are entitled” sijui kama grammar ni sawa, lakini nasoma kama kilivyoandikwa, nadhani ni their entitlement shall be paid through the Office of the National Assembly. Mimi napendekeza iwe “the Clerk of National Assembly.”

SPIKA: Sababu?

MHE. BALOZI DKT. PINDI H. CHANA: Mheshimiwa Spika, sababu hapa kwenye Chief Court Administrator hawajasema through the Office of Chief Court Administration, wameshema Chief Court Administrator. Kwa hiyo, huku napendekeza iwe Clerk of the National Assembly, lakini naona wataalam watatufafanulia.

SPIKA: Atatufafanulia Mwanasheria Mkuu.

MHE. BALOZI DKT. PINDI H. CHANA: Mheshimiwa Spika, ahsante sana. Eneo lingine kwa haraka sana, ni kuhusu ukurasa wa 8 Ibara ya 17, inasema, “the principal Act is amended in section 6 ina-delete hiyo and substituting for it the following: inaweka wale wadau wa kuingia kwenye hicho chombo, one representative from the Ministry, one representative from Ministry responsible for Regional Administration.”

Mheshimiwa Spika, sasa hawa watu ambao huwa wanaingia kwa Mujibu wa nafasi zao, unakuta hapa kuna Wajumbe takribani nane; kwa kuwa wanaingia kwa mujibu wa nafasi zao kwamba mtu mmoja atatoka BRELA, mtu mmoja atatoka Authority responsible for medical device, mwisho wa siku wanajikuta wote ni Me. Kwa hiyo, naomba wakati hawa watu wanakwenda kuchukuliwa, tuzingatie gender, Me na Ke. Tukiacha hivi hivi, unakuta Bodi fulani wote ni Me. Ukiuliza mbona Bodi hii wote ni Me? Wanasema tumeingia kwa mujibu wa nafasi zetu.

Mheshimiwa Spika, naomba kuwasilisha. Kwa hiyo, wataalam tuongeze labla kifungu kinachosema gender should be considered. Mtaweka grammar vizuri.

Mheshimiwa Spika, eneo lingine ukurasa wa 9, Kifungu cha 23 amendment of the Mining Act. Kifungu cha 23 kinatafsiri pale gross value means the market value of mineral or mineral at the point of refining or sale in case of consumption within Tanzania.” Sasa mineral, kuna diamond, gold, gemstone na kadhalika. Nilitaka kujua tu sisi watu tunaotoka Mchuchuma na Liganga, Makaa ya Mawe humu yamo au kwenye hii tafsiri haimo, nayo yamekuwa treated humu Pamoja? Ni ili kupata kufahamu.

Sasa unaenda kusema insurance ya mtoto, unaambiwa aah, huyo mwisho ni miaka 18. Miaka 21 bado yuko Chuo, bado yupo University ananitegemea, unaambiwa hamna Bima.

Kwa hiyo, Serikali imejirekebisha, Bima sasa itamtambua mtoto hadi miaka 21. Katika hili, napongeza sana. Naomba maelekezo wakati Mwanasheria Mkuu ana wind-up hapo: Je, ni kuanzia lini? (Makofi)

Mheshimiwa Spika, kwa hiyo, tungependa maelekezo yako, sisi kuanzia lini twende pale National Health Insurance tulete Watoto wetu? Kuanzia kesho ruksa au mpaka isainiwe au nini? Mheshimiwa Naibu Spika, moja kwa moja ukurasa wa sita kifungu cha 6(1) actually ni kifungu cha 5(1) kwa mujibu wa muswada; the principal Act is amended by repealing section 6; pale section 6 inasema kwamba; the Minister shall appoint the Executive Director of the Board on such terms and conditions as he may determine. Napendekeza badala ya neno as he may determine tuweke as per public service guidelines.

Mheshimiwa Naibu Spika, eneo lingine kifungu cha 6(2)(d) inasema kwamba wale watu watakaochaguliwa pale kwenye (d) has at least ten years work experience out of which, eight years being in managerial position. My question is has at least ten years work experience; which experience? I think it should experience on the relevant field, kwa sababu mwingine anaweza akawa ten years experience but experience ya lawyer and not as accountant, so kama wataalamu wa uandishi wanaweza wakaangalia at least ten years work experience may be on the relevant field, isiwe open.

Mheshimiwa Naibu Spika, eneo lingine sana sana napongeza kwenye sanction na penalty ndiyo nita-focus sana, naenda ukurasa wa 10 wa muswada ambapo ukurasa wa 10; oh my God, kuna page nyingine haijatoka page nine, ukurasa wa 10 hapa kifungu cha 11 cha muswada ambacho kina kinazungumzia establishment of accounts and auditors; section 24 kwamba; there is hereby established an appeals board to be known as Accountants and Auditors Appeal Board which shall consist of; pale kwenye (b) yake kuna (i), (ii), wameelezea a lawyer, a law officer, one senior member from Ministry responsible for finance, one senior member from Bank of Tanzania and one senior member from TRA.

Mheshimiwa Mwenyekiti, eneo lingine ukurasa huo, huo section 12, hiki kifungu cha 12 naipongeza sana Serikali kutuletea haya marekebisho, kwamba hiki Kifungu sasa kinafutwa, kwa kweli nitumie nafasi hii kupongeza, lakini pia kwa ruksa yako nitumie nafasi hii kukumbashana kwamba hata kama hapa mwisho ilisema; “and shall not be subject to review by any court.” Kwa mujibu wa Katiba kwamba Katiba ni sheria mama hata kama hiki kifungu kilikuwepo haizuii mtu kwenda Mahakamani kudai rights zake.

Mheshimiwa Mwenyekiti, kwa hiyo hata kama kilikuwepo mtu ana rights zake Mahakamani kwenda ruksa. Kwa sababu tunajua nini maana ya Katiba, lakini napongeza kabisa kifungu hiki kufutwa, lakini haki ya wananchi ilikuwa haijazuiliwa, walikuwa wana haki kwenda kudai their right in any court kwa sababu wanakwenda kwa mujibu wa Katiba.

Mheshimiwa Mwenyekiti, enelo lingine ukurasa wa 14, kifungu cha 30B(3) page 14; “A person who refused to produce further information under this section, commits an offence and shall, on conviction, be liable to a fine not exceeding twenty million, minimum haipo, au tunaenda na maximum bila kufunga chini kwamba Hakimu, Jaji ataamua kama ni shilingi kumi, shilingi ishirini, thelathini, laki au ni vizuri kufunga na chini not less than.
